Dear Mr. Bell,
This letter responds to your request under the State Open Records Act for correspondence between the Town Manager's office and Apex Development LLC regarding the Riverside PUD rezoning, together with related staff reports and studies.
The Town has completed a search of six record systems and located 18 responsive records. Your request is GRANTED IN PART. Fourteen records are released, several with redactions; three records are withheld in full and one is withheld pending a litigation hold, as itemized below and in the enclosed records index.
Records released with redaction
Personal contact details of private third parties and Town staff have been redacted under §708(1)(a) (personal privacy). For example:
"…please call me directly at 555-0148 or reach my assistant Jenna at jparks@apexdev.co to set the pre-application meeting for the Riverside parcel…"
Records withheld
Attorney work product. One memorandum from the Town Attorney assessing legal risk of the rezoning is withheld in full under §708(1)(f) (attorney-client privilege / litigation).
Pre-decisional drafts. Two draft versions of the traffic-impact study containing internal deliberative comments are withheld under §708(1)(g) (deliberative process). The final adopted study is released in full.
Litigation hold. One email thread is subject to an active litigation hold in Cedar Creek Alliance v. Town of Millbrook and is withheld pending counsel review; it will be addressed by supplemental determination.
Fees & appeal rights
A fee estimate of $18.50 (search + duplication) is enclosed. You may appeal any withholding or redaction to the Millbrook Town Attorney within 30 days, and thereafter to the State Information Commissioner.
